Is it legal to draw from a photograph?
Photographs can be copyrighted. A drawing made from a copyrighted photograph is a derivative work; such a drawing can be published only if the copyright owner of the underlying photograph has given his express consent. The artist of the drawing also has a copyright on all aspects original to his or her drawing.
Can I use stock photos for art?
Artwork for sale that uses a stock image requires an Extended License. This is even if you manipulate an image. It is considered that the primary value of your artwork is in the stock photo itself. In essence, without the stock photo, your artwork would not exist and you would have nothing to sell.
Can I draw a picture of a celebrity and sell it?
You can sell a fine art painting of a celebrity as long as it is a transformative work of art. This means it needs to be artistic in nature, not just a faithful likeness. With photographs and other types of artwork, the US copyright law goes into effect immediately – with or without a registration mark. Even if an artist sells their artwork, they own the copyright to it. The buyer cannot make prints or sell copies of it without written permission.
